Conor E. McCarthy

Conor McCarthy is an experienced Real Estate and Estate Planning attorney, and has spent nearly 15 years helping his clients navigate and resolve complex transactions and disputes. Conor began his career as a civil litigator zealously advocating in contract, construction, real estate, land use and commercial disputes. He then transitioned to become a skilled municipal and transactional attorney negotiating and closing complex commercial and real estate deals, and resolving difficult land use challenges. After managing the City of Tacoma & Tacoma Public Utilities’ real estate transactions for several years, and serving as In-House attorney for a local real estate developer, Conor returned to private practice to focus his efforts on helping his clients and their families achieve their Real Estate and Estate Planning goals. Serving clients large and small, private and public, Conor prides himself on taking the time to listen and fully understand a client’s challenges and goals. A passion for service and justice led Conor to pursue a career in law and serve his community on the Tacoma City Council.

  • Real Estate & Land Use. Conor is prepared to help you achieve your real estate and land use goals. Litigation:  Adverse Possession, Quiet Title, Ejectment, Trespass, Waste, Construction Disputes, Unlawful Detainer, Eminent Domain, Residential Landlord Tenant Act.  Land Use:  Guidance and advocacy through zoning issues, platting and subdivision, boundary line adjustments, and through GMA, SEPA, SMA, and various laws affecting land development; as well as guidance with respect to the Model Toxic Controls Act pertaining to real estate transactions.
  • Estate Planning – Wills, Trust, & Probate. Conor capably Probates estates and assists Trustees in trust administration. Conor helps his clients plan for the future, and protect their families and assets. Conor drafts both simple and complex Wills and Trusts; as well as health care directives, powers of attorney, community property agreements, and other documents necessary to implement estate plans. Conor will provide you with representation to suit your family’s unique needs.
  • Business. Conor represents and counsels clients in all aspects of their day-to-day business, ranging from entity formation & corporate governance to commercial transactions and business disputes. Conor assists clients through employment issues, intellectual property matters, and construction matters. Representative services include:  Formation and Governance: Formational Documents for Profit and Not For Profit Corporations, Partnerships, and Limited Liability Corporations; Operating Agreements and Shareholder Agreements; Articles of Incorporations, Bylaws, and Corporate Resolutions & Corporate Dissolution; Employment Agreements; Non-Compete Agreements; Work for Hire Agreements; Indemnity/Waiver Agreements; Contracts and Commercial Transactions:  Contracts for construction, architectural and engineering services, consultant services, supply of goods, equipment, and vehicles, inter-local action, public-private development, software license and maintenance, artwork, public sculpture and more; Asset & Sale of Business Agreements; Trademark and Copyright Registration & Licensing.
  • Previously Conor provided counsel as an in house-attorney for a real estate developer. He also served as Assistant City Attorney and Legal Counsel for Municipal Government & Special Purpose Districts in Real Estate, Contracts, Land Use, Public Works, Procurement, Bid Protests, OPMA, Public Records Act, & Governance.
  • Conor’s dedication to service and community can be seen through his extensive civic engagement and volunteer work. He currently serves on the board of directors for several non-profits, multiple City of Tacoma committees and task forces all working to tackle tough and complex issues facing our community.
  • He is admitted to practice in all Washington State Courts and U.S. District Courts for Western Washington.
